A de facto relationship can exist between two persons of different sexes or between two persons of the same sex. It can also exist if one of the people is legally married to someone else or in another de facto relationship. As a rule of thumb, people living together in a romantic relationship without being married to each other are generally in a de facto relationship, whether they share assets or not.
1. the person applying for the property settlement made substantial contributions; and
2. there would be a serious injustice to the person applying for the property settlement if no property settlement order was made.
